AI file CMYK color profile identified as RGB

Hi,
I'm trying to identify the color profile of Illustrator file.

Saved as Illustrator CS

The color profile has been set to CMYK in Illustrator. Then saved with "Create PDF Compatible File" and "Embed ICC profiles" options on. I tried different export versions of the file (AI10, AI CS, AI CS3, AI CS5)
When I open the file with Photoshop it recognizes the profile (which is Coated FOGRA39), but when I run identify, it always give me RGB color space (PaletteMatte type). What should I do to make the identify recognize the correct color space?

We can reproduce the problem you posted and have a patch. Look for it in the next point release of ImageMagick within a few days. Thanks.
